1. Role of the Marketplace & Limitation of Liability

cosycookie.com is an online venue and hosting service. Agate International LTD is not a retailer, does not stock inventory, does not fulfill orders, and does not handle the shipping, transit, or delivery of any items sold on the platform.

Crucial Legal Notice: The contract for the sale and delivery of goods is formed strictly between the Buyer and the Seller. Agate International LTD is completely exempt from any liability, loss, damage, expense, or delay arising from the packing, shipping, handling, customs clearance, or delivery of items purchased through the platform. Any disputes regarding transit or non-delivery must be handled directly between the Buyer and the Seller according to the procedures outlined below.

2. Information for Buyers

Because cosycookie.com features independent Sellers globally, shipping options, pricing, couriers, and timelines vary significantly depending on the Seller’s location and choice of carrier.

  • Shipping Rates and Methods: Shipping fees are entirely determined by individual Sellers and are displayed clearly at checkout. Buyers are responsible for selecting and paying for their preferred shipping tier.

  • Delivery Timelines: “Estimated Delivery Dates” provided on listings are approximations generated by Sellers or carrier estimates. They are not legal guarantees.

  • Tracking: If a Seller provides tracking details, this data is shared directly with the Buyer for convenience. cosycookie.com does not manage or verify carrier tracking data.

  • Incorrect Information: Buyers must ensure their shipping address is accurate and complete at the time of checkout. Neither the Seller nor Agate International LTD is responsible for packages lost, delayed, or misdelivered due to incorrect addresses provided by the Buyer.

3. Requirements for Sellers

Sellers bear full operational and legal responsibility for getting items safely into the hands of Buyers. By opening a storefront on cosycookie.com, Sellers agree to:

  • Accurate Disclosure: Clearly specify “Ships From” locations, accurate shipping charges (or offer transparent free shipping), and strict handling/processing times inside every listing.

  • Independent Fulfillment: Select, book, and fund their own shipping carriers or fulfillment operations.

  • Compliance: Fully adhere to all local and international shipping, postal, and customs regulations, including restrictions on dangerous or prohibited goods.

  • Proof of Postage: Retain valid, legally recognizable proof of postage and tracking for every item shipped. In the event of a missing item dispute, the Seller must be able to produce tracking showing delivery to the exact address provided by the Buyer at checkout.

  • Safe Packaging: Pack all items securely to ensure they survive standard international and domestic transit conditions.

4. International Shipping, Customs, and Import Duties

For orders crossing international borders (including shipments entering or leaving the United Kingdom):

  • Buyer Responsibility: Unless explicitly stated otherwise by the Seller (e.g., using specific DDP/Delivered Duty Paid shipping terms), the Buyer is considered the “Importer of Record” and is solely responsible for paying any import VAT, customs duties, tariffs, and courier handling fees applied by their destination country upon arrival.

  • Customs Delays: cosycookie.com and Agate International LTD are not liable for packages delayed or held by international customs offices or border protection agencies.

  • Regulatory Compliance: Sellers are uniquely responsible for filling out customs declarations (e.g., CN22/CN23 forms) truthfully and accurately.

5. Lost, Damaged, or Undelivered Shipments

In the event that an item is damaged in transit or fails to arrive:

  1. Direct Resolution: The Buyer must first contact the Seller directly via the cosycookie.com internal messaging system to report the issue.

  2. Seller Accountability: Because the Seller chose the courier and contract of carriage, the Seller is responsible for opening claims or investigations with their chosen shipping carrier.

  3. Marketplace Intervention: If a Buyer and Seller cannot reach an amicable resolution regarding a lost or damaged item, either party may escalate the matter to cosycookie.com Customer Support. Our team will review whether the Seller provided valid proof of shipment to the correct address. If the Seller cannot provide valid proof of delivery, they will be required to issue a full refund to the Buyer.

  4. No Financial Liability: Any refunds forced by the marketplace during dispute resolution will be debited directly from the Seller’s platform balance or registered payment method. Agate International LTD will not under any circumstances financially cover, insure, or reimburse losses incurred by transit failures.

6. Policy Modifications

Agate International LTD reserves the right to amend this Global Shipping Policy at any time. Changes will become effective immediately upon being posted to cosycookie.com. Continued use of the platform following any updates constitutes an acceptance of the revised terms.
